Writs

A writ is a legal document that orders a person or entity to perform or stop performing a specific action. Writs are often issued by courts or other entities with administrative or judicial jurisdiction, and are part of common law.
Here are some types of writs:
  • Certiorari
A higher court orders a lower court to send the record of a case for review.
  • Habeas corpus
A prisoner is demanded to be brought before the court to determine if there is legal authority to detain them.
  • Mandamus
A higher court orders a lower court or government officer to perform mandatory duties correctly.
  • Prohibition
A subordinate is directed to stop doing something that the law prohibits.
  • Procedendo
A case is sent from an appellate court to a lower court with an order to proceed to judgment.
In India, the Supreme Court and High Courts have the authority to issue writs to uphold fundamental rights. These writs are an important part of the Indian judicial system and are incorporated under Articles 32 and 226 of the Constitution.
